
SHEBOYGAN, WI (WHBL) - A Sheboygan man currently serving time in prison for raping a Sheboygan woman in 2011 has lost his appeal.
23 year old Tyshan Simmons raped an intoxicated 14 year old girl in an alley off of Erie Avenue. His first trial in Sheboygan County Court ended with a hung jury. He was tried again, found guilty and sentenced to six years in prison in August of 2012 by Judge L. Edward Stengel
In a decision handed down Wednesday, the Appeals Court ruled there “is no arguable merit to any issue that could be raised on appeal," thus upholding the conviction and sentence.
