Cascade Man Takes Plea For Accidental Child Death

SHEBOYGAN, Wis. (WHBL) -- A Cascade man charged in the accidental death of his fiancee's son has reached a plea deal with prosecutors.

32-year-old Armando Aguirre has agreed to plead no contest to second degree reckless injury. Under the plea bargain, prosecutors have agreed to recommend five years in prison and three years on extended supervision.

Police say Aguirre was playing with his fiancee's four year old son and his own three year old son when they asked to be swung around. He picked up the four year old by the feet and started swinging, when the boy's head hit the floor. The child suffered a seizure and brain injury, and was transported to Children's Hospital in Milwaukee where he later died.

At a preliminary hearing in the case, District Attorney Joe DeCecco said, "We believe his account as far as what he was doing, but we think maybe he slipped, maybe he miscalculated. That child hit that floor really hard, and that’s what caused the ultimate conditions that led to his death."

The plea comes a week before the case was set to head to trial. Aguirre will be back in court for sentenced April 7th.
