SHEBOYGAN, WI (WHBL) - A Neenah man will have to spend one year and 90 days in jail for committing his fifth OWI offense.
Judge Timothy Van Akkeren sentenced 33 year old Phia Lee this week after he pleaded no contest to the OWI, plus tampering with an ignition interlock device. A charge of operating a motor vehicle while revoked was dismissed.
The criminal complaint against Lee states a Sheboygan Police officer conducted a traffic stop July 31 of a vehicle registered to him that was operating outside the hours Lee was allowed to for his occupational license. Lee would be arrested after he performed field sobriety tests and registered a preliminary breath test level of point-11.
When interviewed later, Lee admitted he was taking his then 14 year old son fishing, but had at least one beer before driving. The son reportedly added he blew into the vehicle’s ignition interlock device so it could start for his dad.
In addition to the jail time, Lee will serve three years of probation, have his license revoked for five years, and continue to use an ignition interlock for at least five more years.
