Falling down on Moped Leads to Fourth OWI, Jail Time

SHEBOYGAN, WI (WHBL) - A Sheboygan man will serve 75 days in the local jail for his fourth OWI offense.  Judge James Bolgert recently sentenced Duane Klein to the jail time, plus fines, revoked his drivers' license for two years, and requiring him to use an ignition interlock for two years.

In the original criminal complaint filed against Klein, a Sheboygan County Sheriff’s deputy noticed the 51 year old was on a moped on Indiana Avenue in Sheboygan June 1 when it tipped over while performing a U-turn.  Klein reportedly tried to ride away but was stopped by the deputy.

Klein also refused to perform field sobriety tests, and deputies needed a warrant to get blood drawn to find out what his blood alcohol level was.

As part of a plea deal, a charge of operating a vehicle with a prohibited alcohol concentration, his fourth in five years, was dismissed.
