Sheboygan Man Uses Son to Fool Interlock Device. Drives Drunk. Fifth Time

Sheboygan, WI (WHBL) – 33-year-old Phia Lee was arrested on Friday, July 31, 2015, after Sheboygan police allege he registered a .11  blood alcohol level during a traffic stop on New Jersey Ave. The breathalyzer test was administered  after an officer said that Lee smelled of alcohol. Lee told the officer that he drank one and a half beers before being pulled over.

The officer also noticed that Lee’s 15-year-old son was in the passenger seat of the car. They were on their way to a friend’s house to pick up bait, and go fishing.

The officer ran a check on Lee’s driving record and discovered that;

a. He was restricted to driving for work , and only during set hours .

b. Due to previous OWI convictions, Lee was restricted to having a blood-alcohol level of  no more than .02.

c. Use of an interlock device is required as a driving condition.

The officer wondered how Lee was able to start the vehicle, given his blood-alcohol level. Lee’s son later admitted that he blew into the interlock breathalyzer, so that his father could drive.

His previous OWI convictions occurred in 2003, 2005 2007 and January 2015.

This time, Lee is charged with operating while intoxicated-fifth offense, tampering with an ignition interlock device, operating a motor vehicle while revoked, and contributing to the delinquency of a child. The combined charges could land him more than a decade in jail.
