
SHEBOYGAN, WI (WHBL) - A Sheboygan man lost his appeal Wednesday for refusing to take a sobriety test.
Last September, a Sheboygan Police officer found 54 year old Robert Kowalis passed out behind the wheel of a vehicle on Kentucky Avenue. The officer arrested him for possibly being drunk and asked him to take a test to confirm this. Kowalis refused, prompting the charge which Judge L. Edward Stengel found him guilty of.
Kowalis’ attorney appealed the ruling, saying the officer did not have the right to arrest and charge his client. The Second District Appeals Court affirmed Stengel’s ruling, saying the officer acted properly in this incident.
Kowalis will have his license revoked for three years, followed by having an ignition interlock installed for three years.
