
SHEBOYGAN, WI (WHBL) - Lying to an officer is never a good idea, nor is being uncooperative to them. Doing both will give most anyone charges, and that is what happened to a Fond du Lac man in Sheboygan this past weekend.
24 year old Carlos Moya faces six charges; including his third OWI, second operating with a revoked license, obstructing and resisting, disorderly conduct, and discharging bodily fluids at an officer.
The criminal complaint states that on August 30 on Indiana Avenue, a Sheboygan Police officer stopped a vehicle that had taken a recent turn at an unsafe high speed.
The driver, who identified himself as Jose Mendoza, reportedly told officers he was trying to catch up to a vehicle he claimed damaged his. However, when officers found no evidence of damage or a driver’s license identifying Mendoza, they were going to take him into custody.
That’s when the driver allegedly became agitated and uncooperative, resisting when officers tried to handcuff him and place him into a squad car. He's accused of yelling swear words and racial slurs, and also trying to spit at an officer, but missed.
When taken to the police station the man continued to be verbally and physically resistant, but police were able to positively identify the suspect as Moya after using a Fast ID machine.
Moya started complaining about a possible broken finger and allegedly remained uncooperative when EMS personnel came to treat him. This forced his transport to St. Nicholas Hospital, where Moya is accused of continuing to be verbally abusive and spitting wherever before a spit hood was used. A short time later, Moya began to complain about being drunk and threw up several times - leading to the OWI charges.
In Sheboygan County Court Monday Moya was given a one-thousand dollar cash bond. He now faces over seven years in prison if convicted of all charges.
