
WAUKESHA, WI (WHBL) - The Sheboygan County District Attorney’s office has lost its appeal of a judge’s ruling which threw out drug charges against a Sheboygan man. 32 year old Jesse Schwartz was arrested on drug charges in February of last year after Sheboygan police, investigating a hit and run accident, forced their way into his home on Martin Avenue and then spotted marijuana plants. That’s when they obtained a warrant, but Judge James Bolgert suppressed the drug evidence, ruling the residence had already been searched without a warrant. The state appealed the ruling but, in a decision handed down Wednesday, the Appeals Court upheld Bolgert. Schwartz had been facing four drug charges.
